AUGUSTA – An Augusta man arrested in May for threatening to kill a woman while brandishing a gun was recently indicted by a grand jury for also raping the woman after allegedly causing her to be impaired.

Ray C. Mack, 28, was indicted by a Kennebec County grand jury last week on two counts of aggravated sexual assault and one count of criminal threat with a dangerous weapon and possession of a firearm by a prohibited person.

Aggravated sexual assault charges allege that Mack, between May 24 and May 26, engaged in a sexual act with a woman who was unconscious or physically unable to resist and who had not consented to the intercourse . The indictment indicates that it would have impaired a woman’s “power to assess or control her sexual acts by providing, administering or using drugs, intoxicants or other similar means”.

Mack was arrested in May by police in Augusta who alleged, according to court documents, that he threatened to kill the woman by brandishing a gun, after he and another man discovered a text message on her. a friend of hers called saying she would report drug trafficking involving the three of them to the police.

Police obtained a search warrant and arrested Mack after searching an apartment on Waldo Street where police said they found a handgun.

The prohibited person’s possession of a firearm indictment alleges that Mack was in possession of a firearm and was convicted, or found not criminally responsible by reason of insanity, burglary, 2nd degree, in 2010 in New York.

An indictment is not a determination of guilt, but indicates that there is sufficient evidence for a case to be tried.
