Kochi, May 26 (IANS): The actress, who has accused actor-producer Vijay Babu of rape, petitioned the Kerala High Court on Thursday not to grant her early bail as a defendant cannot decide the terms of bail.
The court, after hearing both sides, said the plea of the actor-producer, who has been on the run since the allegations were published, will not be considered if he does not return to Kerala on May 30, and released the file for Friday.
Kerala Police did their best to bring back Vijay Babu, who escaped the country last month to Dubai and from there – after police started issuing a red corner notice – headed for the Georgia and is now there.
His lawyer has already informed the court that he will land in Kerala on Monday.
The actor-producer was on the run after the Kozhikode actress filed a complaint in Ernakulam on April 22 for being repeatedly raped and beaten by him in an apartment in Kochi.
She also accused him of giving her intoxicants before sexually abusing her.
Shortly after the news surfaced, Vijay Babu appeared live on his social media account claiming he was the ‘real victim’ in the case, adding that he would take appropriate legal action against the complainant whom he also named.
The police, in addition to the initial complaint, registered a second complaint against him for disclosing the complainant’s name.
With his early release plea likely to be settled on Friday, if the court does not grant him bail, it remains to be seen whether he will land in Cochin on Monday or not.
